Board Administrative Policies (Updated April, 2024)
Policy #1 - Bill paying procedure.
A bill will not be paid without a prior Board approval, except as provided in Policy #3.
Policy #2 - Registered Agent.
Registered agent of Lakewood Village Property Owners Association, Inc. of Springfield, Missouri shall be Marinel Hopkins of Tax Relief Center to be filed with the Missouri Secretary of State. This resolution shall continue in force until the LVPOA Board of Directors vote to change the registered agent.
Policy #3 - Payment of Bills Without Prior Board Approval.
The accounting firm is allowed to pay the routine bills of LVPOA as approved in the current budget of by the Finance Chair or the Finance Committee.
Policy #4 - Dues.
Dues are to be paid annually or semi-annually. Dues notices will be sent by first class mail on or before January 1. Annual dues are delinquent if the total is not paid before February 1. Semi-annual dues are delinquent if one-half of annual dues are not paid before February 1 and the other half before August 1. Statements are sent when dues become delinquent and a late charge of $25.00 per month will be added.
The names of the delinquent members will be listed in the monthly budget report and published on the website. Property owners who are 90 calendar days delinquent will forfeit use of all facilities, swimming pool privileges and trash service; however non-use of facilities does not relieve their dues obligation. Further, when dues are 90 calendar days delinquent, lien procedures may/will be initiated and the owners will be responsible for all fes and cost incurred.
Policy #5 - Minutes & Financial Reports.
Minutes and financial reports of directors and annual/special meetings shall be posted on the Lakewood Village Property Owner's Association website, lakewoodvillagepoa.com.
Policy #6 - Meetings / Parties For Over 75 People.
Meetings of parties involving 75 or more people shall have special board approval.
Policy #7 - Loaning of Clubhouse Furniture and Grounds Equipment
LVPOA furniture and equipment in the clubhouse and on the grounds shall not be loaned or removed for any reason.
Policy #8 - Payment for Materials and Services Provided by LVPOA Members.
It shall be the policy of the Board to pay for all materials and services provided by LVPOA members, except those materials and services donated or volunteered. Dues shall not be waived in lieu of payment for materials and services received from LVPOA members.
Policy #9 - Licensed Insured Contractors.
All construction, repair, remodeling or maintenance work covered by the building, electrical, gas or plumbing codes as adopted by the City of Springfield or which requires the issuance of any city license or permit for it's performance, shall be contracted to be done by duly licensed and insured vendors who shall provide proof of such licensing and insurance prior to LVPOA entering into any contract with such vendor.
Policy #10 - Use Restrictions.
The Declaration of Use Restrictions as recorded on November 15, 1971 shall continue to apply to all lots in the subdivision and cannot be changed until January 1, 2000. LVPOA Board herewith directs the Architectural Control Committee to use this policy regarding compliance with the restrictions.
* THE FOLLOWING PARAGRAPHS: A, B, C, D AND E refer to and are additions to the DECLARATIONS OF USE RESTRICTIONS filed by the Lakewood Development Company, January 3, 1973 and are marked ADDENDUM NUMBER ONE to Declarations of Covenants, Conditions and Restrictions filed with the Recorder's Office of Greene County, Mo on October 6, 1970m439.6 pm in Book 1529, Page 2345.
A. Paragraph 3 of the Declaration permits approval of an "other enclosure" in addition to an enclosed garage. Parking and storage of recreational vehicles, campers, boats and trailers shall be permitted in the backyard behind a wood privacy fence approved by the Architectural Control Committee for the purpose of shielding the object from view. Parking of recreational vehicles, campers, boats and trailers are permitted in driveways not to exceed 72 hours Parking of trucks greater than 1/4 ton and commercial vehicles other than defined as temporary shall not be permitted other than in an enclosed garage.
B. Paragraph 4 of the Declaration provides for approval of fences. No fence shall be erected at any time between the front of any dwelling and the street. No fence shall be erected at the side of back of any dwelling without prior approval in writing from the Architectural Control Committee. The Architectural Control Committee will approve wood fences of standard type to include privacy fences 3' to 8' height, split rail or post type rial fences, picket, etc. Chain link or wire fences shall not be approved. Combination wood and wire fences or other non-standard fences shall be permitted only after receiving approval by all abutting neighbors and concurrence by the Board.
C. "Other structure" as used in PARAGRAPH 6 of the Declaration is interpreted to include basketball goals, clotheslines & post and satellite television dishes. Basketball goals must be in the backyard area to be approved. Clotheslines & post and satellite dishes must be placed in the backyard behind a wood privacy fence approved by the Architectural Control Committee for the purpose of shielding the object from view. A storage shed or outbuilding shall be placed in the backyard behind a wood privacy fence approved by the Architectural Control Committee. Temporary and portable basketball goals will be permitted in the front driveway.
D. PARAGRAPH 15 of the Declaration states that "No antenna or tower shall be erected upon any lt for the purpose of radio operation, unless with prior written approval of the Architectural Control Committee". Normal sized antenna for the purpose of receiving radio and television transmissions may be placed on dwellings and buildings, however, inside mounting is encouraged. Freestanding antenna or tower shall not be approved.
E. No other exceptions to the Declaration of the Use Restriction shall be permitted without approval by the Board and amendment of this policy.
